Hive Takes Swedish Crypto Tax Fight to European Commission

Bitcoin mining firm Hive Digital Technologies has escalated its tax dispute with Swedish authorities by filing a complaint with the European Commission. The case centres on two local subsidiaries, Bikupa Datacenter AB and Bikupa Datacenter 2 AB, which have been denied VAT refunds since 2022.

The Swedish Tax Agency reclassified their operations as self-directed mining rather than the provision of computing power to clients. This change blocks recovery of input VAT on costly equipment, cooling systems and electricity.

Law firm Dentons, acting for Hive, says Swedish courts have repeatedly refused to refer the matter to the Court of Justice of the EU. The company hopes the Commission will examine the classification of such services and clarify the rules for data-centre businesses across the bloc.
